1. Acceptance of Terms

By accessing this website or purchasing services from Streamwise (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service.

If you do not agree with these terms, you should not use our services.

2. Description of Services

Streamwise provides digital marketing and automation services including but not limited to:

  • Website design and hosting

  • CRM setup and automation

  • SMS automation and missed call text-back systems

  • Lead follow-up automation

  • Review request automation

  • Digital marketing consultation

Services are provided on a subscription or project basis as agreed in writing.

3. Subscription & Billing

For subscription services:

  • Services are billed monthly unless otherwise agreed.

  • Payment is due in advance.

  • Failure to pay may result in suspension or termination of services.

  • Setup fees (if applicable) are non-refundable.

All fees are listed in Canadian Dollars (CAD).

4. Cancellations & Termination

Clients may cancel subscription services with written notice.

Unless otherwise agreed:

  • A minimum 30-day notice is required.

  • No partial refunds are provided for unused time.

  • Upon cancellation, access to hosted systems, automation, and related software will be revoked.

Streamwise reserves the right to terminate services for:

  • Non-payment

  • Misuse of systems

  • Violation of applicable laws

  • Harassment or abusive behavior

5. Client Responsibilities

Clients agree to:

  • Provide accurate business information

  • Ensure compliance with Canadian Anti-Spam Legislation (CASL) and other applicable laws

  • Obtain proper consent before sending SMS or marketing communications

  • Use the systems ethically and legally

Streamwise is not responsible for client misuse of automation systems.

6. SMS & Communication Compliance

If SMS automation services are used:

  • Clients are responsible for obtaining express consent from contacts.

  • Clients must include opt-out language in their communications.

  • Message frequency, content, and targeting are the responsibility of the client.

Streamwise is not liable for fines, penalties, or violations arising from improper SMS usage.

You must be 18 years of age or older to use this SMS service.

7. Intellectual Property

All proprietary systems, automation workflows, templates, designs, and configurations created by Streamwise remain the intellectual property of Streamwise unless otherwise agreed in writing.

Clients are granted a limited, non-transferable license to use services during their active subscription.

Upon cancellation:

  • Access to proprietary systems may be revoked.

  • Ownership of custom website content created specifically for the client may transfer upon full payment (excluding underlying systems and frameworks).

8. Limitation of Liability

Streamwise is not liable for:

  • Lost revenue or business opportunities

  • Service interruptions caused by third-party providers

  • Carrier message filtering or SMS delivery issues

  • Google review filtering or removal

  • Website downtime beyond our reasonable control

To the maximum extent permitted by law, our liability shall not exceed the total fees paid in the previous 3 months.

9. Third-Party Services

Our services may rely on third-party platforms including but not limited to:

  • CRM providers

  • SMS gateways

  • Hosting providers

  • Google services

Streamwise is not responsible for outages, policy changes, or service interruptions caused by third-party providers.

10. No Guarantee of Results

While our systems are designed to improve lead capture and conversion, we do not guarantee:

  • Specific revenue increases

  • Specific lead volumes

  • Specific Google ranking improvements

Results depend on market conditions, competition, and client participation.

Carriers are not liable for delayed or undelivered messages.

11. Indemnification

Clients agree to indemnify and hold harmless Streamwise from any claims, damages, fines, or liabilities resulting from:

  • Client misuse of services

  • Failure to obtain marketing consent

  • Violation of laws or regulations

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated terms will be posted on our website.

Continued use of services constitutes acceptance of revised terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada.

14. SMS Communications

By providing your phone number and opting in through our website forms or other communication channels, you consent to receive SMS messages from Streamwise.
